Dimapur, September 23 (MExN): In reference to the directive received from the All India Organisation of Chemists and Druggists (AIOCD), the Nagaland Medicine Dealers Association (NMDA) has requested all the wholesalers not to “disallow any claim sent by retailers up to December 31, 2017.” NMDA president A Ato Yepthomi and Ashok Kr Singhal in a press release said that with the GST implementation from July 1, 2017 in India, “the major challenge is the concept of sale and purchase as earlier in VAT regime has been replaced by GST i.e. inward supply and outward.” Hence, any supply is subjected to GST tax, including movement of date expired goods. Looking to the provisions under GST law, there is ambiguity in the minds of the dealers for settlement of leakage, breakage or expiry goods, the Association stated. The trade and industry, both are in a clear position to receive the goods and settle the claim. Hence, the retailer and wholesalers are having expired goods with them from the last quarter and also it will take further two months for clarity, it added.
