Court quashes govt resolution on SVC

DIMAPUR, NOVEMBER 25 (MExN): The Kohima Bench of the Gauhati Court has, in an order allowed the PIL filed by the Nagaland Tribes Council (NTC) on restoration of legal powers and jurisdiction of the State Vigilance Commission. The court heard the PIL for two days on November 21 and 22.  

The court, in its order, “set aside and quashed” the Nagaland Government’s resolution dated June 8, 2016, which the NTC had stated “is found to be detrimental as there must be an authority acting as a deterrent to corrupt activities in the State in the interest of the general public.” The court further directed re-opening of all inquiry/investigation which were affected by the terms of the resolution dated 8/6/2016.  

It may be noted that the NTC had urged upon the Government of Nagaland to restore the legal powers and jurisdiction of the State Vigilance Commission by revoking the “erroneous cabinet resolution without delay.” “However, the State Government remained insensitive to the demand tabled which compelled NTC to take the issue to the Hon’ble High Court for redress of public grievances,” a press note from the petitioners informed.  

The NTC expressed hope that with this directive, the State Government “will take steps to restore the State Vigilance Commission to its rightful position as before.”
